License Agreement for NFL Mobile App

This NFL Mobile App (the "App") is provided by Verizon Wireless ("VZW") so that you can receive certain content licensed to VZW by the NFL. This Service is solely for your use and is subject to this Agreement. YOUR USE OF THE APP, OR ANY INCLUDED SOFTWARE AND THE SERVICE, IS YOUR ACCEPTANCE OFTHIS AGREEMENT.

1. Other Agreements; Charges for the Service. Your use of the App or Service is subject to your Customer Agreement with VZW. You agree to all one time and recurring charges, including taxes and surcharges, that apply to the Service and its content, which will be applied to your VZW bill or your prepay account balance. Download of the App and use of the Service will be billed based on your price plan and usage.

2. Location Information, Blackouts and Restrictions on Video Streaming. When you use the Service, we will periodically check your location using GPS to enforce NFLP blackouts of games, and also to determine whether you are in a stadium or the immediate vicinity of game venues so we can restrict access to video streaming. VZW may share location information with third parties only to provide the Service. To learn about VZW's information collection and use practices, please refer to the VZW Privacy Policy. If you do not want us to use your location for these purposes, please don't use the Service.

3. Limited License. Sujeto a este Acuerdo, Verizon Wireless le garantiza licencia para su uso individual, privado y no comercial en el dispositivo en el que se instaló la Aplicación en un principio.

4. Restricciones en cuanto al uso. You may not, or allow others to, adapt, alter, modify, de-compile, reverse engineer, translate, or create derivative works of the software. You may not, or allows others to, use the App or Service outside of the U.S. (including its territories and possessions).

5. Ownership. VZW and its licensors retain exclusive ownership of all proprietary and intellectual property rights worldwide, in and to the App and Service. All rights not expressly granted are reserved.

6. Copyright. All App content, including graphics, text, images, logos, audio and video materials, and software, as well as the compilation of the content, is the property of VZW and/or its licensors and is protected by U.S. and international copyright laws. VZW reserves the right to terminate the accounts of users infringing the copyrights of others.

7. Termination. VZW may terminate or discontinue the Service at any time, including if you breach this Agreement.

8. Disclaimer of Warranty. THE APP AND SERVICE ARE PROVIDED "AS IS", WITHOUT WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND BY EITHER VZW, THE NFL OR ANY THIRD PARTY

9. Trademarks. "Verizon Wireless," the "NFL," its member team marks and logos and "NFL Mobile" are all trademarks, service marks and/or registered trademarks of Verizon Wireless and/or their respective owners. No license is granted to you in this Agreement, either expressly or implicitly, to use any trademark, service mark, names or logos used in the App or Service.

10. Applicable Law. The laws of the State of New York, excluding its conflicts-of-law rules, govern this Agreement, and you expressly agree that jurisdiction for any claim or dispute arising under this Agreement shall reside in the federal and state courts in New York County, New York.

11. Safety. Please do not endanger yourself and others by using the App or Service while driving or engaging in any other activity that requires your full attention.
