PLEASE READ THIS LEGAL CONTRACT CAREFULLY AND COMPLETELY. EL CONTRATO RIGE EL USO DE LA APLICACIÓN SAFE WI-FI, LÍMITA LA RESPONSABILIDAD DE VERIZON PARA CONTIGO Y REQUIERE QUE RESUELVAS CUALQUIER DISPUTA CON VERIZON MEDIANTE ARBITRAJE VINCULANTE E INDIVIDUAL EN VEZ DE JUICIO POR JURADO O DEMANDA COLECTIVA. SI NO ESTÁS DE ACUERDO CON ALGUNA PARTE DE ESTE CONTRATO, NO HAGAS CLIC EN ACEPTAR NI USES SAFE WI-FI. COMENZARÁS A INCURRIR EN CARGOS POR USO DE DATOS UNA VEZ QUE LA CONFIGURACIÓN DE SAFE WI-FI SE HAYA COMPLETADO.
- CUSTOMER AGREEMENT. Your overall relationship with Verizon is governed by the terms of Your Customer Agreement, including the arbitration provision, as well as your data plan, and are supplemented by these Terms of Service ("TOS") when you are using the Safe Wi-Fi app. In the event of a conflict between these TOS and the Customer Agreement, these TOS govern when you are using the Safe Wi-Fi app.
- DEFINITIONS. In the TOS: (a) "Verizon" means Verizon Wireless; (b) "We" and "Us" means Verizon and our third-party licensors and; (c) "You" and "Your" mean an individual who uses Safe Wi-Fi and any person or entity represented by that individual.
- SOFTWARE. The Safe Wi-Fi app includes software provided by us, our affiliates or our third-party licensors ("Software"). We may update the Software from time to time and your failure to install any update may affect your use of the Safe Wi-Fi app and/or the Software. You may use the Software only as part of, or for use with, the Safe Wi-Fi app, as authorized in these TOS.
Subject to the terms of these TOS, We grant you a limited, revocable, non-exclusive, non-transferable license to use the Safe Wi-Fi app and the Software solely as authorized under your data plan and the Customer Agreement. Please also see the "Data Services" section of the Verizon Wireless Important Plan Information document to learn more about permitted and prohibited data uses. All rights regarding use of the Safe Wi-Fi app and Software not expressly granted in this Agreement are reserved by us and/or any of Verizon's third-party licensors.
You may not adapt, alter, modify, reverse engineer, de-compile, disassemble, translate, attempt to derive source code from or create derivative works of the Safe Wi-Fi app or Software, or otherwise tamper with or modify any security features or other service components for any reason (or allow or help anyone else to do so). You also agree to follow all rules and policies applicable to the Safe Wi-Fi app, including the installation of required or automated updates, modifications and/or reinstallations of Software and obtaining available patches to address security, interoperability and/or performance issues.

The Safe Wi-Fi app utilizes proprietary technology to allow users to create a secure Wi-Fi connection with a VPN on their mobile device. The Safe Wi-Fi app uses information obtained from your device, including IP address and Wi-Fi access point data, to establish and provide the VPN service. The Safe Wi-Fi app collects your mobile number, which is used to confirm your eligibility to use Safe Wi-Fi and for billing purposes. Neither Verizon nor its third party licensor(s) or vendors access or collect any information that you send or receive through your Safe Wi-Fi secure connection. - RESTRICCIONES EN EL USO. La aplicación Safe Wi-Fi está destinada para uso personal solamente. You may download and use the Safe Wi-Fi app only if You can form a binding contract with Verizon and You are not a person who is barred from downloading or using the Safe Wi-Fi app by laws of the United States or any other applicable jurisdiction. No usarás la aplicación Safe Wi-Fi de ninguna manera que viole cualquier norma, ley o reglamento aplicable, o infrinja cualquier derecho de autor, marca comercial u otro derecho de propiedad intelectual o divulgue un secreto comercial o información confidencial. Tú no: (a) descompilarás, harás ingeniería inversa, desensamblarás, derivarás el código de fuente o la decodificarás; (b) harás ninguna modificación, adaptación, mejora, traducción o trabajo derivado de la misma; (c) la alquilarás, arrendarás, venderás, redistribuirás, prestarás, distribuirás, sublicenciarás o transferirás a un tercero; (d) eliminarás, ocultarás o modificarás cualquier aviso de propiedad, incluidos los avisos de derechos de autor o de marca; ni (e) la instalarás o utilizarás en más de un dispositivo.
- MISUSE. You shall not misuse the Safe Wi-Fi app, including, without limitation, using it in any manner that: (a) interferes with or interrupts it or any hardware, software, system or network connected with it; (b) stalks, harasses, threatens or harms any person or is otherwise invasive of another's privacy rights; (c) uses it on a device without permission; (d) tampers with or makes an unauthorized connection to any network, including, without limitation, the network of any wireless carrier; (e) disseminates viruses or other computer code, files or programs that interrupt, destroy or limit the functionality of it or any other computer software or hardware.
- FAQs & SPECIFIC FUNCTIONS. The Safe Wi-Fi FAQs are available at https://www.verizonwireless.com/support/safe-wifi-faqs/. Please read them carefully and completely before using Safe Wi-Fi.

YOU ACKNOWLEDGE AND AGREE THAT SAFE WI-FI AND SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND THAT YOUR USE OF OR RELIANCE UPON SAFE WI-FI IS AT YOUR SOLE RISK AND DISCRETION. WE HEREBY DISCLAIM ANY AND ALL REPRESENTATIONS, WARRANTIES AND GUARANTIES REGARDING SAFE WI-FI, WHETHER EXPRESS, IMPLIED OR STATUTORY, AND INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ADEMÁS, VERIZON NO GARANTIZA QUE: (I) SAFE WI-FI CUMPLIRÁ CON TUS REQUISITOS; (II) SAFE WI-FI ESTARÁ DISPONIBLE, SERÁ PUNTUAL, ACTUAL, PRECISA, CONFIABLE, COMPLETA, SEGURA O QUE ESTARÁ LIBRE DE ERRORES; (III) LA CALIDAD DE LOS PRODUCTOS, SERVICIOS, INFORMACIÓN U OTRO MATERIAL AL QUE ACCEDAS U OBTENGAS A TRAVÉS DE SAFE WI-FI SERÁ COMO SE REPRESENTA O CUMPLIRÁ CON TUS EXPECTATIVAS; O (IV) NINGÚN ERROR DE SAFE WI-FI SERÁ CORREGIDO. NINGÚN TIPO DE CONSEJO O INFORMACIÓN, YA SEA ORAL O ESCRITO, QUE OBTENGAS DE VERIZON O LICENCIANTES TERCEROS DE VERIZON O CUALQUIER TERCERO, CREARÁ NINGUNA REPRESENTACIÓN O GARANTÍA. FURTHERMORE, YOU ACKNOWLEDGE AND AGREE THAT VERIZON AND ITS THIRD-PARTY LICENSOR(S) HAVE NO OBLIGATION TO SUPPORT OR MAINTAIN SAFE WI-FI. YOU ACKNOWLEDGE AND AGREE THAT VERIZON AND ITS THIRD-PARTY LICENSOR(S) MIGHT NOT BE ABLE TO OFFER SAFE WI-FI AT ALL, IN THE ABSENCE OF THE FOREGOING DISCLAIMERS AND LIMITATIONS. IN THE EVENT OF ANY FAILURE OF SAFE WI-FI TO CONFORM TO ANY APPLICABLE WARRANTY, YOU MAY NOTIFY VERIZON, AND VERIZON AND ITS THIRD-PARTY LICENSOR(S), AS YOUR SOLE AND EXCLUSIVE REMEDY, USE COMMERCIALLY REASONABLE EFFORTS TO SATISFY THE WARRANTY. VERIZON AND ITS THIRD-PARTY LICENSOR(S) WILL HAVE NO OTHER WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO SAFE WI-FI, AND ANY OTHER CLAIMS, LOSSES, LIABILITIES, DAMAGES, COSTS OR EXPENSES ATTRIBUTABLE TO ANY FAILURE TO CONFORM TO ANY WARRANTY WILL BE YOUR SOLE RESPONSIBILITY.
- LIMITACIÓN DE RESPONSABILIDAD. LAS SIGUIENTES LIMITACIONES SE APLICARÁN A TI EN LA MEDIDA MÁXIMA PERMITIDA POR LAS LEYES APLICABLES. BAJO NINGUNA CIRCUNSTANCIA SEREMOS RESPONSABLES DE DAÑOS INDIRECTOS, ACCESORIOS, RESULTANTES, EJEMPLARES O ESPECIALES QUE SURJAN DE O ESTÉN RELACIONADOS CON EL ACCESO A, O USO DE, O LA IMPOSIBILIDAD DE ACCEDER O USAR SAFE WI-FI, YA SEA QUE LOS DAÑOS FUERAN O NO PREVISIBLES Y YA SEA QUE HUBIÉRAMOS SIDO O NO INFORMADOS DE LA POSIBILIDAD DE DICHOS DAÑOS INCLUYENDO, ENTRE OTROS, DAÑOS POR PÉRDIDA DE INGRESOS O GANANCIAS, IMPOSIBILIDAD DE TRANSMITIR O RECIBIR DATOS, PÉRDIDA, MAL USO O DIVULGACIÓN DE INFORMACIÓN CONFIDENCIAL, INTERRUPCIÓN DEL NEGOCIO, PÉRDIDA DE PRIVACIDAD, CORRUPCIÓN O PÉRDIDA DE DATOS, IMPOSIBILIDAD DE RECIBIR O RESPALDAR TUS DATOS (O DATOS ARCHIVADOS) O CUALQUIER OTRA PÉRDIDA PECUNIARIA DE CUALQUIER TIPO QUE SURGIERA DE O DE ALGÚN MODO SE RELACIONARA CON SAFE WI-FI. LAS LIMITACIONES ANTERIORES SE APLICARÁN INCLUSO SI LA SOLUCIÓN MENCIONADA ANTERIORMENTE NO CUMPLE EL PROPÓSITO ESENCIAL.
- INTELLECTUAL PROPERTY RIGHTS. You agree that all copyrights, patents, trademarks, trade secrets and other intellectual property rights associated with Safe Wi-Fi are respectively Verizon's and our third-party licensors' exclusive property, and all such rights not expressly granted to You herein are reserved and retained by Verizon and our third-party licensor(s), as applicable. You further acknowledge that neither Verizon nor Verizon third-party licensor(s), by acceptance of Your submission, waive any rights to use similar or related ideas previously known to Us, or developed by Verizon or Verizon's third-party licensor(s) employees or obtained from sources other than You.
- INDEMNIZACIÓN. Aceptas indemnizarnos, defendernos y eximirnos de responsabilidad en relación con cualquier reclamación, procedimiento, pérdida, daño, responsabilidad o gasto de cualquier tipo que surja de o esté relacionado con lo siguiente: (a) tu uso o mal uso de Safe Wi-Fi; (b) tu incumplimiento presunto o real de los TOS; (c) tu violación, supuesta o real, de las normas, leyes o reglamentos aplicables; (d) tu negligencia o falta de ética; o (e) tu violación, supuesta o real, de los derechos de propiedad intelectual u otros derechos de terceros. We reserve the right, at Your expense, to assume the exclusive defense and control of any matter which You are required to indemnify, and You agree to cooperate in that defense.
- ADDITIONAL TERMS AND CONDITIONS FOR MOBILE APPS DOWNLOADED FROM THE APPLE APP STORE. Solo puedes usar la aplicación Safe Wi-Fi en dispositivos iOS que sean de tu propiedad o estén bajo tu control, según lo permitido por las Reglas de uso establecidas en los Términos de servicio de Apple App Store. Tú y nosotros reconocemos que: Apple no tiene la obligación de proporcionarte ningún tipo de servicio de mantenimiento y asistencia en relación con la aplicación Safe Wi-Fi, que Apple y sus subsidiarias son los beneficiarios de estos Términos, y que al aceptar estos términos y condiciones, Apple tendrá derecho a ejecutar estos términos en tu contra como tercero beneficiario de estos Términos. Apple no se responsabiliza por ninguna reclamación de tu parte o de terceros en relación con la aplicación Safe Wi-Fi, incluyendo reclamaciones por violación de derechos de autor, o tu uso o posesión de la aplicación Safe Wi-Fi, incluyendo a título enunciativo pero no limitativo: (i) reclamaciones por responsabilidad del producto, (ii) cualquier reclamación relacionada con el incumplimiento de la aplicación Safe Wi-Fi en relación con cualquier ley o requisito normativo aplicable, (iii) reclamaciones que surjan de la protección del consumidor o leyes similares, o (iv) reclamaciones, pérdidas, responsabilidades, daños, costos o gastos atribuibles al incumplimiento, de cualquier índole, de garantías expresas o implícitas por parte de la aplicación Safe Wi-Fi. Ante el incumplimiento de garantías por parte de la aplicación Safe Wi-Fi, puedes informar a Apple y Apple, a tu único y exclusivo recurso, reembolsará el monto, si lo hubiere, que pagaste por la aplicación Safe Wi-Fi.
